Terms of Use

Welcome to ToonCam ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the ToonCam mobile application ("App") and related services. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

ToonCam is an AI-powered photo transformation application that allows users to convert their photos into anime-style artwork. The App uses artificial intelligence technology to process and transform images uploaded by users.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the App.

3. Subscriptions and Payments

3.1 Billing

Payment is charged to your Apple ID account at the confirmation of purchase. Subscription prices are clearly displayed in the App before you complete your purchase.

3.2 Auto-Renewal

Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same subscription rate.

3.3 Managing Subscriptions

You can manage and cancel your subscriptions by going to your Apple ID Account Settings after purchase. To cancel, turn off auto-renewal in your account settings at least 24 hours before your current subscription period ends.

3.4 Free Trials

We may offer free trial periods for certain subscription plans. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to ToonCam, where applicable.

3.5 Price Changes

We reserve the right to change subscription prices at any time. Any price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use of the App after a price change constitutes your agreement to pay the updated amount.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload, transmit, or process any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Use the App to generate content that infringes upon the rights of any third party, including intellectual property rights or rights of privacy
• Attempt to gain unauthorized access to the App, its servers, or any related systems or networks
• Use the App in any manner that could damage, disable, overburden, or impair the service
• Use automated means, including bots, scrapers, or scripts, to access or interact with the App
• Reverse engineer, decompile, or disassemble any portion of the App
• Use the App to create content intended to deceive, defraud, or mislead others

5. Intellectual Property

5.1 Our Property

The App, including its design, features, functionality, and all related content, is owned by ToonCam and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

5.2 Your Content

You retain ownership of the original photos you upload to the App. By uploading content, you grant us a limited, non-exclusive license to process and transform your images solely for the purpose of providing the service. We do not claim ownership of your original photos or the generated artwork.

5.3 Generated Content

The anime-style artwork generated through the App is provided for your personal use. You may share and use your generated artwork, subject to these Terms and applicable laws.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

7. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from the App will be accurate or reliable
• The quality of the generated artwork will meet your expectations
• Any defects in the App will be corrected

8. Limitation of Liability

To the maximum extent permitted by applicable law, ToonCam and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the App, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising out of or relating to the use of the App exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless ToonCam, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App or violation of these Terms.

10. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the App will immediately cease
• All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability

You may terminate your use of the App at any time by deleting it from your device and canceling any active subscriptions through your Apple ID Account Settings.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms within the App or on our website and updating the "Last updated" date. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in California.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
